Field of application
The present conditions are applicable in all the commercial relations - products and services - between Swiss Alpine Wine and its customers. Any other conditions are only valid if they are in writing and signed by authorised persons.
Opening an account
The customer will inform Swiss Alpine Wine of any change of name, address or company name.
Price
All catalogue prices and prices published on the Internet are without obligation. We reserve the right to adjust prices to current market rates. We reserve the right to make changes to prices and product ranges. Price changes will be applied immediately without prior notice. VAT will be shown separately on the invoice. Additional costs may be charged for packaging and dispatch. All deliveries, transport, services and unloading are subject to VAT.
Orders
Products are ordered by the customer on the basis of individual orders, in person, in writing, by e-mail, on the online shop or by telephone.
A cancellation of order, which Swiss Alpine Wine did not accept, leads to a payment on behalf of the customer of an amount equivalent to the expenses engaged by the company.
No goods will be delivered on invoice to a person on behalf of third parties, without their authorization.
Packaging
Lost packaging (glass, cardboard, etc.) will not be collected from the customer's home.
Late delivery
Swiss Alpine Wine cannot be held responsible for delivery delays due to transport difficulties. In the event of delay, all expenses, damages and interests will be excluded.
Receipt of goods
The goods must be inspected on receipt. Any defects must be noted immediately on the delivery note, in the form of handwritten reservations, accompanied by the customer's signature. Defective products must not be accepted, otherwise they are deemed to have been accepted.
Complaints must be made immediately, but at the latest within 7 days of delivery.
Return of goods
All return requests must be made in writing within 7 days of receipt of the goods. Swiss Alpine Wine is not able to accept the return of goods without prior notice and without its agreement. Transport costs for the return of goods are at the customer's expense, unless otherwise agreed with Swiss Alpine Wine. Special orders cannot be returned.
Guarantee
Goods in respect of which a complaint has been made must not be used under any circumstances. All costs arising from failure to comply with this rule shall be borne by the customer. A defective product that has been received or used is deemed to have been accepted.
In case of complaints made within the time limit concerning a product with a defective quality that can be attributed to Swiss Alpine Wine, the latter will replace the offending goods free of charge and as quickly as possible. Any other claim for compensation or civil claim is excluded. Swiss Alpine Wine declines any responsibility as for the choice of the delivered products, as well as on the consequences of their use, like the consequences of the use of defective products.
For replaced products, Swiss Alpine Wine gives the same guarantee as for the initial services.
Swiss Alpine Wine declines any responsibility in the event of use or treatment not satisfying the rules of the art, in the event of abusive consumption, non-observance of prescription, inadequate storage or similar cases.
Complaints about the goods delivered do not release the customer from the obligation to pay on time.
No other claims on the part of the customer will be taken into consideration, in particular claims for compensation for damage not directly related to the delivery itself.
Invoice complaints
Complaints about any billing errors must be made within 10 days of receipt of the invoice.
Payments
The invoices relating to amounts due are payable, without additional expenses, in the 30 days following the date of invoicing. The delivered goods remain the property of Swiss Alpine Wine until the complete payment of the invoice. No other deduction is accepted, except written agreement on behalf of Swiss Alpine Wine. Payment by credit card on the online shop is net and does not give right to discount.
Swiss Alpine Wine reserves the right to require a cash payment, a production of guarantee or a payment in advance.
Deliveries on credit may be blocked with immediate effect for customers in arrears with their payment.
Contractual integrity
In the event that one of the clauses of these general terms and conditions is contrary to a mandatory national or international provision, all of the provisions of these general terms and conditions shall not be null and void and the parties shall do their utmost to maintain the effects of the invalid clause, as well as the balance of these general terms and conditions of sale.
